This website (hereinafter the "Site") is published by the company SAUTHON INDUSTRIES, a public limited company with a share capital of €3,000,000, whose registered office is located at 6,8,10 Route de Cher du Prat – 23000 GUERET, registered in the Guéret Trade and Companies Register under number B 421 195 298 (hereinafter "SAUTHON").
Article 1 – General Provisions
- Scope and purpose
These general terms and conditions of sale (hereinafter the "GTC") are entered into between SAUTHON and any non-trader individual (hereinafter the "Customer") wishing to purchase products offered for sale by SAUTHON (hereinafter the "Products") on the Site.
These GTC are intended to govern the sale of products made by SAUTHON to Customers via the Site. They specifically define the terms under which Customer orders are placed, delivered, paid for, and how Customers can access tracking information for their order.
The parties agree that deliveries of Products offered for sale on the Site are limited to the following territories: Metropolitan France excluding Corsica.

- Acceptance of the general terms and conditions of sale
Any order placed on the Site by the Customer is subject to these GTC. The Customer declares that they have read and accepted these GTC before paying for the order by checking the box provided for that purpose. Validation of the order constitutes acceptance of these GTC by the Customer.
- Modification of the general terms and conditions of sale
These GTC will remain in effect as long as they are accessible on the Site. It is understood that SAUTHON may adapt or modify these GTC at any time. The modification of the GTC will only take effect for orders placed after the modifications are published online, except where the modification results from a mandatory requirement imposed by law immediately applicable in French territory. In such case, SAUTHON will inform the Customer without delay.
If the Customer wishes to keep a copy of the GTC in effect at the time of placing the order, they are invited to print these GTC.
Article 2 – Products
2.1 Product characteristics
The Customer can obtain the essential characteristics and description of the products before placing an order. All this information is displayed on the product sheets (hereinafter the "Product Sheets") to which the Customer has access by clicking on the Product. The Customer thus can view the price, dimensions, colors, and availability of the Products.
Photographs of the Products are also available on the Product Sheets to illustrate the Products. The Products are presented as accurately as possible. However, the Customer acknowledges that there may be differences between the photographs on the Product Sheets and the actual Products. Therefore, the photographs on the Site are for indication only.
In the event that SAUTHON makes changes to one or more Products, the photograph of the Product cannot engage SAUTHON’s liability, nor affect the validity of the sale.
2.2 Product availability
The availability of Products is indicated on the Product Sheets by a colored dot:
- If the dot is green: the Product is available and can be ordered by the Customer;
- If the dot is red: the Product is not available and cannot be ordered by the Customer.
SAUTHON reserves the right at any time to modify the range of Products offered for sale on the Site.
Article 3 – Product Prices
The selling prices of the Products offered on the Site are shown in euros, all taxes included, and take into account eco-contribution.
Any change in the VAT rate on the day the order is placed will be fully passed on to the selling price of the Products ordered. The prices shown take into account any discounts granted to the Customer on the day the order is placed.
The prices do not include shipping costs, which are billed in addition to the price of the Products. Shipping costs are communicated to the Customer before confirming the order and are defined in these GTC.
Prices are guaranteed within the limits of available stock. In the event of a Site malfunction resulting in incorrect information given to the Customer, SAUTHON reserves the right to cancel current orders and refund any sums already collected associated with them. If the indicated price is evidently absurd compared to the real value of the Product due to an error, SAUTHON may also cancel current orders and refund any collected sums.
SAUTHON may modify the price of the Products at any time. The price applicable on the day of the order will be the price explicitly displayed on the Product Sheet on the Site. Products will be billed based on the prices in effect at the time the order is placed on the Site.
Article 4 – Orders
4.1 Customer identification on their customer account
To place an order, the Customer can log in with their customer account using their email address and the corresponding password.
For any first order, the Customer may create a customer account on the Website.
To create their customer account, the Customer must provide their first and last name, date of birth, address, email address, and choose a password linked to their customer account.
The Customer acknowledges that the use of the email address and associated password is personal. Therefore, the Customer is responsible, under all circumstances, for all actions carried out via their customer account and for the use of their login credentials by third parties on the Website, except in cases where the Customer has informed SAUTHON, by any written means, of the misuse or fraudulent use of their credentials.
4.2 Order process
4.2.1 Product selection
On the Website, the Customer can select one or more Products. The Customer can consult the Product Pages using a search by product types or product references.
The Customer adds the Product to the cart by clicking on “Add to cart” and can either continue shopping by clicking on “Continue shopping,” or proceed to payment by clicking on “Order.”
At any time, the Customer can:
- check the Products in their cart: quantity, amount, and detailed information (notably the description and delivery fees) by clicking on the “My cart” icon or on the product photo,
- cancel one or more Products from the cart by reducing the product quantity to zero,
- enter a valid promo code in the “Discount coupons” field and choose a delivery method (which can be modified later),
- continue selecting Products by clicking on “Continue shopping.”
4.2.2 Customer identification
When clicking on “Order,” the Customer is redirected to a page allowing them to either:
- Create a customer account using the dedicated form, in accordance with Article 4.1 of these T&Cs;
- Log in to an existing customer account using their email address and corresponding password.
4.2.3 Order confirmation
The Customer then accesses the “Address” section, where they can select the address previously entered when creating their customer account or in the “Instant order” section, or provide a new billing address different from the delivery address. The Customer may also send a message to SAUTHON.
To access delivery information, the Customer clicks on “Order.”
The Customer confirms the selected delivery method.
The Customer must indicate to SAUTHON whether they agree to receive the Product(s) in recycled packaging and whether they wish the Product(s) to be gift-wrapped. The Customer acknowledges that any request for gift-wrapping will be subject to an additional charge of two (2) euros.
On this page, a checkbox states “I have read and accept the general terms and conditions of sale.” This box must be checked by the Customer to proceed with the order confirmation. The present T&Cs are available for the Customer to read before ticking the box.
Once the Customer has ticked this box, they are deemed to have knowingly and unreservedly accepted these T&Cs, as well as all elements of their order, including prices, volumes, and quantities of the Products offered for sale and ordered.
After clicking on “Order,” the Customer is redirected to a secure page to securely enter their bank details. Payment will be made in accordance with Article 5 of these T&Cs. Until the payment has been completed, the order can be modified at any time by clicking on the "Continue shopping" icon at the bottom left of the screen.
Final acceptance is therefore given by entering the Customer's bank details (credit card number, expiration date, and security code on the back of the card) for online payment.
Any order with online payment will only be processed under the following conditions:
- the country of delivery must be included in the list specified in Article 1 of these T&Cs;
- payment must be accepted by the GIE cartes bancaires, as verified via the Mercanet BNP PARIBAS payment server at https://payment-webinit.mercanet.bnpparibas.net/
Once the Customer’s payment has been made, SAUTHON will send a confirmation of the order by email indicating all elements of the order. The sale is considered final only after this confirmation. This confirmation should be kept by the Customer.
The Customer is informed that they have a period of fourteen (14) days to withdraw from the purchase under the conditions outlined in Article 7 of these T&Cs.
4.3 Protection of the SAUTHON brand and collections
The Products offered for sale on the Website are intended for consumer customers only, that is, natural persons acting for purposes unrelated to their commercial, industrial, artisanal, liberal, or agricultural activity.
The collections developed by SAUTHON may be subject to piracy, copying, imitation, and unfair competition. Orders that clearly or merely aim to gather information about the collections will not be fulfilled. These orders will be refunded if applicable.
In any case, SAUTHON reserves the right to take legal action against the perpetrator of such practices.
4.4 Order confirmation and archiving
The order number is communicated to the Customer as soon as the transaction is accepted by the bank. The confirmation, which recalls the order number and summarizes the ordered Products, shipping fees, and payment method, is immediately sent to the Customer by email.
Orders are archived in the Customer’s personal account. The Customer can thus consult the history of their orders.
Article 5 – Payment of Products
5.1 Payment Methods
The Customer may pay for the order using the following methods:
- bank card
If paying by bank card, SAUTHON accepts the following cards:
- VISA
- MASTER CARD
- CARTE BLEUE
All orders must be paid in full at the time of placing the order and in euros. No charge is made to the Customer's bank card before the scheduled shipping date of the order or at the latest seventy-two (72) hours after the order is placed by the Customer.
In the event of partial delivery, only the value of the delivered Products is charged to the bank card transaction.
5.2 Combating Bank Card Fraud
SAUTHON is committed to fighting fraud.
If their bank card is fraudulently used, the Customer is invited to contact SAUTHON as soon as the misuse is discovered.
SAUTHON may take any measures it deems necessary to verify that there is no fraud and that the person whose bank account was debited is indeed the one who placed the order.
In this context, SAUTHON notably uses the 3-D Secure secure payment protocol, which allows the Customer to be authenticated. This protocol confirms that the Customer is the legitimate cardholder, thereby enhancing transaction security.
SAUTHON reserves the right to suspend or cancel any order and/or delivery. The same applies in the event of non-payment of any amount due by the Customer or in the event of a payment incident.
In any case, the Customer guarantees SAUTHON that they act lawfully and in accordance with legal rules. They guarantee that they have the necessary authorizations to use the chosen payment method when registering their order.
Article 6 - Delivery
6.1 Delivery Conditions
Deliveries may only be made to the territories referred to in Article 1 of these GTC. Delivery costs are the responsibility of the Customer and are indicated to the Customer when checking the product's availability.
6.2 Shipments
The logistical processing before the order is shipped is carried out within a maximum of seventy-two (72) working hours from the day after the order is validated by the Customer.
6.3 Delivery Times
Delivery times are communicated to the Customer when placing the order. They are calculated from the day following the validation of the order by the Customer.
This period is estimated based on the order processing in SAUTHON’s warehouses and the transport times offered by the carriers.
In any case, the Products will be delivered within a maximum of five (5) working days from the handover of the Products to the carrier.
6.4 Delivery Terms
Deliveries can be made to the Customer's address or to any other address specified when placing the order.
Furniture deliveries are made at ground floor level or at the building entrance, by appointment.
In any case, the Products are shipped to the address entered by the Customer when placing the order. SAUTHON declines all responsibility in the event of an address entry error by the Customer that leads to an incorrect delivery location.
The Customer can track the delivery status from their customer account on the Site.
6.5 Delivery Delays
In accordance with Article L. 216-2 of the Consumer Code, if the delivery time indicated to the Customer is exceeded, the Customer must request SAUTHON, by registered letter with acknowledgment of receipt or another durable medium, to deliver within an additional reasonable period. If this period is also exceeded, the Customer may terminate the contract under the same conditions.
In this case, the contract will be considered terminated upon receipt by SAUTHON of the letter or written notice informing them of the termination.
In the event of termination due to a delivery delay, SAUTHON must reimburse the Customer for all amounts paid, corresponding to the price of the undelivered Product(s), within a maximum of fourteen (14) days from the date the Customer terminated the contract, in accordance with Article L.216-3 of the Consumer Code.
If SAUTHON is unable to fulfill its delivery obligation due to circumstances beyond its control, particularly in the event of force majeure, SAUTHON will inform the Customer immediately to proceed with the cancellation of their order.
Article 7 – Right of Withdrawal
Pursuant to Article L. 221-18 of the Consumer Code, the Customer has a period of fourteen (14) days to exercise their right of withdrawal.
7.1 Start of the Withdrawal Period
This fourteen (14) day period begins from the date the Product is received by the Customer.
When the order includes several Products and multiple delivery dates, the withdrawal period starts from the date the last Product is received by the Customer.
7.2 How to Exercise the Right of Withdrawal
To exercise their right of withdrawal, the Customer must inform SAUTHON of their decision to withdraw by sending, within the aforementioned deadlines, the form attached to these GTC, or any other unambiguous declaration expressing the desire to withdraw.
SAUTHON will acknowledge receipt of the Customer’s withdrawal on a durable medium.
In case of a dispute, it is the Customer's responsibility to prove they have exercised their right of withdrawal in accordance with Article L. 221-22 of the Consumer Code.
The return costs of the Product(s) concerned remain the responsibility of the Customer.
7.3 Returning the Products
The Customer has a period of fourteen (14) calendar days following the communication of their withdrawal decision to return all or part of the delivered Product(s) to the following address:

The Customer must ensure that all returned Products are:
- in their original packaging,
- in perfect resalable condition and have never been used,
- accompanied by the return form printed from the customer account on the site.
7.4 Refund
Upon receipt of the Products by SAUTHON and after inspection, the refund at the invoiced price at the time of the order of the returned Products will be made no later than fourteen (14) days following receipt. The refund of initial shipping costs will be made based on the standard delivery rate.
SAUTHON is not required to reimburse delivery costs if the Customer has expressly chosen a more expensive delivery method than the standard one offered.
All risks related to the return of the Product(s) are borne by the Customer. Any risk of loss or damage is transferred to the Customer when they or a third party designated by them (other than the carrier offered by SAUTHON) physically takes possession of the goods (Art. L. 216-1 of the Consumer Code).
Article 8 – Retention of Ownership
SAUTHON retains full ownership of the Products until full payment of the price by the Customer.
These provisions do not prevent the transfer of the risk of loss or damage of the Products to the Customer upon receipt by them or a third party designated by them (other than the carrier) of the Products subject to the retention of ownership.
Article 9 – Product Warranty
9.1 Statutory warranties
SAUTHON is the seller of the products offered on the Site and is responsible for their compliance with the contract. If necessary, the Customer may submit a request under the statutory conformity warranty provided for in Articles L.217-4 et seq. of the French Consumer Code or under the warranty for hidden defects of the item sold within the meaning of Articles 1641 et seq. of the French Civil Code, as described below, to SAUTHON.
All products sold by SAUTHON benefit from the statutory conformity warranty provided for in Articles L.217-4 to L.217-13 of the Consumer Code and the warranty against hidden defects as set out in Articles 1641 to 1648 and 2232 of the Civil Code. These articles are reproduced below:
It is recalled that when acting under the statutory conformity warranty, the Customer:
- has a period of two (2) years from the delivery of the goods to take action;
- may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code;
- is exempt from proving the existence of the lack of conformity of the goods during the twenty-four (24) months following delivery. The statutory conformity warranty applies independently of any commercial warranty that may have been granted.
It is recalled that when acting under the warranty for hidden defects:
- The Customer may decide to invoke the warranty against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code and, in this case, may choose between cancellation of the sale or a reduction in the purchase price in accordance with Article 1644 of the Civil Code.
The action resulting from hidden defects must be brought by the Customer within two years from the discovery of the defect (Article 1648 paragraph 1 of the Civil Code).
9.2 Commercial warranty
The commercial warranty means any contractual commitment by a professional towards the consumer to reimburse the purchase price, replace or repair the good, in addition to their legal obligations. No commercial warranty is granted by SAUTHON.
Article 10 – Personal data
SAUTHON attaches great importance to the protection of the personal data of its Customers (hereinafter "You") and undertakes, as part of its activities, to ensure the protection and security of personal data (hereinafter "Personal Data").
To this end, SAUTHON ensures that all Personal Data processing it carries out complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation, GDPR) as well as French Law No. 78-17 of January 6, 1978 on data processing, files and freedoms, as amended.
10.1. Our commitments to the protection of Personal Data
SAUTHON commits to the essential principles for the protection of Personal Data:
- Transparency: we provide all necessary information on the purposes and recipients of your collected Personal Data;
- Legitimacy and relevance: we collect and process only Personal Data necessary for the declared purposes;
- Confidentiality, security, and integrity: we implement all reasonable technical and organizational measures to protect your Personal Data from disclosure, loss, alteration, or access by unauthorized third parties;
- Retention: we retain your Personal Data only as long as necessary for the processing or service in question;

10.5 Recipients of Personal Data
10.5.1 SAUTHON undertakes not to sell, rent, or transfer your Personal Data to third parties.
Recipients include SAUTHON personnel in charge of IT, administrative, marketing, customer relationship, prospecting services, and technical providers managing the website.
10.5.2 SAUTHON may transfer your Personal Data to third parties if legally required or justified by legitimate interest.
Our Partners processing your Personal Data do so under our instructions and are contractually bound to confidentiality and to use the data solely for the services rendered for SAUTHON.

10.6 Personal Data retention period
SAUTHON retains Personal Data as long as necessary for the purposes it was collected.
Personal Data related to your customer account and website usage is retained for three (3) years from your last activity or contact. After that period, SAUTHON will deactivate the account and inform you; unless you object, it will be deleted.
Audience measurement statistics and browsing data are kept for no longer than thirteen (13) months.
Data related to orders is stored for three (3) years in the active database.
Some data may be archived to meet legal, accounting, and tax obligations (e.g., ten (10) years for invoice retention under Article L.123-22 of the Commercial Code).
10.7 Security of Personal Data
SAUTHON is committed to ensuring Personal Data security and preventing any unauthorized disclosure, alteration, or destruction.
Personal Data is processed confidentially by SAUTHON’s authorized staff and service providers using appropriate safeguards to guarantee data integrity and confidentiality.

Article 11 – Cookie Management
11.1 What is a cookie?
Cookies are text files stored on the Client's hard drive by SAUTHON's server or possibly by a third-party server. Always active, cookies are necessary for the proper functioning of the Site. They allow SAUTHON, in particular, to recognize a user from one visit to another thanks to a unique identifier. On a computer, cookies are managed by the web browser.
Two types of cookies are to be distinguished: cookies issued by SAUTHON, and those issued by third-party sites at its request.
Cookies issued by third-party sites are neither set nor controlled by SAUTHON but by third-party companies. These cookies aim in particular to target the Client’s interests through the various Product pages visited on the Site to personalize advertising offers displayed on other platforms.

Article 12 – Intellectual Property
The SAUTHON brand and all the content on the Site belong to SAUTHON.
The Products, descriptive elements (texts, visuals, or sounds), photographs, illustrations, and page layout are creations associated with the brand and are the exclusive property of SAUTHON. All elements contained on the Site may not be reused for any purpose without SAUTHON's prior written consent.
Any reproduction or representation, in whole or in part, constitutes an infringement that may result in the civil and criminal liability of its author.
The creation of any link redirecting to the Site from any platform (Blog, social media, private site, etc.) is prohibited without SAUTHON’s prior written consent.
Similarly, hyperlinks are prohibited without SAUTHON’s prior written consent.
Article 13 – Amicable Dispute Resolution – Complaints
In the event of a dispute, the Client may send any written complaint to SAUTHON at the address listed in these GTC, or directly from the Site. The Client’s complaint will be handled by SAUTHON as soon as possible. In the event of disagreement with the proposed solution, the Client may, at their discretion, resort to the mediation service described below.
In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, SAUTHON adheres to the Consumer Mediator Service of FEVAD (Federation of e-commerce and distance selling), whose contact details are: Consumer Mediator of FEVAD - BP 20015 - 75362 PARIS CEDEX 8 - https://www.mediateurfevad.fr. This mediation is free of charge for all SAUTHON Clients.
The Client and SAUTHON remain free to accept or refuse the mediation as well as, in case of mediation, to accept or refuse the solution proposed by the Mediator.
Article 14 – Applicable Law – Competent Jurisdiction
These GTC are governed by French law.
The competent court in the event of a dispute is the one in the place of residence of the defendant or the place of residence of the Client at the time of the conclusion of the contract or the occurrence of the harmful event.

Article L. 217-4 of the Consumer Code
“The seller delivers a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made his responsibility by the contract or has been carried out under his responsibility.”
Article L. 217-5 of the Consumer Code
“The good conforms to the contract:
1° If it is fit for the purpose usually expected of a similar good and, if applicable:
- if it corresponds to the description given by the seller and possesses the qualities that the seller has presented to the buyer as a sample or model;
- if it has the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or their representative, particularly in advertising or labeling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is fit for any special use sought by the buyer, brought to the seller’s attention and accepted.”
Article L217-12 of the Consumer Code
“Action resulting from a lack of conformity is time-barred after two years from the date of delivery of the good.”
Article L217-16 of the Consumer Code
“When the buyer asks the seller, during the course of the commercial guarantee granted to them at the time of the purchase or repair of a movable good, to carry out a repair covered by the guarantee, any period of immobilization of at least seven days shall be added to the duration of the guarantee which remained to run.
This period runs from the buyer's request for intervention or the provision for repair of the good in question, if this provision is later than the request for intervention.”
Article 1641 of the Civil Code
“The seller is bound by the warranty for hidden defects in the item sold which render it unfit for its intended use, or which so diminish that use that the buyer would not have acquired it, or would have paid a lower price, had they known of them.”
Article 1648 paragraph 1 of the Civil Code
“The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect.”
